Denver Feeds Acceptable Use Policy

This Acceptable Use Policy covers the products, services and technologies provided by Denver Feeds under any ongoing agreement, collectively referred to as the “Products”. It is designed to protect Denver Feeds, our customers and the wider internet community from unethical, irresponsible and illegal activity.

Denver Feeds customers who engage in activities prohibited by this policy may be subject to service suspension or account termination. In serious cases, we may also be legally required to report the activity to the relevant authorities.

This policy was last reviewed on 11 December 2025.

Fair Use

We provide our facilities on the assumption that your use will be consistent with normal business use, as outlined in our offer schedule. If your use is considered excessive, additional fees may be charged or service capacity may be restricted.

We oppose all forms of abuse, discrimination, rights infringement and any action that harms or disadvantages an individual, group or resource.

We expect our customers and, where applicable, their users, referred to as “end users”, to use our Products with the same intent.

Customer Accountability

Customers are responsible for their own actions and for the actions of anyone using our Products with their permission.

This responsibility also applies where an unauthorised person uses our Products as a result of the customer failing to implement reasonable security measures.

By accepting Products from us, customers agree to ensure that anyone using the Products as an end user complies with this policy.

Complaints regarding the actions of a customer or their end users may be forwarded to the nominated contact associated with the relevant account.

If a customer, their end user, or anyone using our Products through the customer violates this Acceptable Use Policy, we reserve the right to terminate the relevant Products, terminate the account, or take any remedial or preventative action we consider appropriate without prior notice.

To the extent permitted by law, no refund or credit will be provided for interruptions to services resulting from a violation of this Acceptable Use Policy.

Prohibited Activity

Copyright Infringement and Unauthorised Material

Our Products must not be used to transmit, distribute or store material that violates any applicable law.

This includes, but is not limited to:

  • Material protected by copyright, trademark, trade secret or another intellectual property right that is used without proper authorisation.
  • Material that is obscene or defamatory.
  • Material that constitutes an unlawful threat.
  • Material that violates applicable export control laws.

The customer is solely responsible for all material they input, upload, distribute, transmit, create or publish through or on our Products.

The customer is also responsible for obtaining all necessary permissions and licences to use any work or material included in their content.

Spam and Unauthorised Messaging

Our Products must not be used to send unsolicited bulk or commercial messages in breach of the laws and regulations applicable in the relevant jurisdiction, commonly referred to as “spam”.

This includes, but is not limited to:

  • Sending spam.
  • Soliciting customers using spam sent through another service provider.
  • Collecting responses to spam sent through another service provider.

Our Products must not be used to operate unconfirmed email, telephone number or other messaging lists.

This includes subscribing an email address or telephone number to a messaging list without the permission of the owner of that email address or telephone number, or storing contact details that have been collected in this way.

All messaging lists operated through or hosted using our Products must use a confirmed opt-in process.

Evidence of the email address or telephone number owner’s express permission must be retained for the entire period that the contact remains on the messaging list.

We prohibit the use of email lists, telephone number lists or databases purchased from third parties for the purposes of spam or unconfirmed messaging.

This policy applies to messages sent using our Products. It also applies to messages sent through another network by a customer, or by someone acting on the customer’s behalf, where those messages directly or indirectly refer recipients to a website or service hosted through our Products.

Unethical, Exploitative and Malicious Activity

Our Products must not be used to advertise, transmit, distribute or otherwise make available any software, program, product or service designed to violate this Acceptable Use Policy or the acceptable use policy of another provider.

This includes, but is not limited to, facilitating:

  • Spam.
  • Network sniffing.
  • Unauthorised pinging.
  • Packet spoofing.
  • Network flooding.
  • Mail bombing.
  • Denial-of-service attacks.

Our Products must not be used to access any account, system or electronic resource where the person or group attempting access does not own the resource or is not authorised to access it.

This includes activities commonly referred to as hacking, cracking or phreaking.

Our Products must not be used to intentionally or recklessly introduce viruses, malware or other malicious code into our Products, systems or networks.

Our Products must not be used for activities intended to harass, threaten, abuse, discriminate against or infringe the rights of another individual or group.

Harassment includes, but is not limited to:

  • Denial-of-service attacks.
  • Hate speech.
  • Advocacy of racial or ethnic intolerance.
  • Activities intended to threaten, abuse or discriminate against another person or group.

Other activities considered unethical, exploitative or malicious include:

  • Obtaining or attempting to obtain services from us with the intention of avoiding payment.
  • Using our facilities to obtain or attempt to obtain services from another provider with the intention of avoiding payment.
  • Unauthorised access, alteration or destruction, or attempted access, alteration or destruction, of information relating to our customers or end users.
  • Using our facilities in a way that interferes with another customer’s or authorised user’s access to or use of our facilities or network.
  • Publishing or transmitting content, or links to content, that incites violence.
  • Publishing or transmitting content that depicts violent acts.
  • Publishing, transmitting or facilitating access to child sexual abuse material.
  • Publishing or transmitting material that threatens another person’s health or safety.
  • Any act or omission that violates applicable consumer protection laws or regulations.
  • Any violation of another person’s privacy.

Our Products may not be used by any person or organisation involved in, or reasonably suspected of being involved in:

  • Illegal gambling.
  • Terrorism.
  • Narcotics trafficking.
  • Arms trafficking.
  • The proliferation, development, design, manufacture, production, stockpiling or use of nuclear, chemical or biological weapons.
  • The development, production or use of weapons of mass destruction or missiles.
  • Supporting, financing or otherwise being affiliated with any person or organisation involved in the activities listed above.

Unauthorised Use of Denver Feeds Property

We prohibit:

  • Impersonating Denver Feeds.
  • Falsely representing a significant business relationship with Denver Feeds.
  • Falsely claiming ownership of Denver Feeds property, including our Products, business name, branding or intellectual property.

This includes using any such representation for the purpose of fraudulently obtaining services, business, patronage or user trust.

About This Policy

This policy provides a non-exclusive list of activities and intentions that we consider unacceptable and incompatible with our business, services and brand.

We reserve the right to modify this policy at any time by publishing a revised version on our website.

The revised policy will take effect from the earlier of:

  • The date the customer first uses our Products after the revised policy is published on our website; or
  • 30 days after the revised policy is published on our website.
